E3 Inspection Association Membership Application

The E3 Inspection Association of Professional Exterior Elevated Element Inspectors (referred to herein as the “Association”) was formed to facilitate the establishment of the highest professional standards in inspecting Exterior Elevated Elements in accordance with the governing legislative authority codified in California Civil Code §5551 and California Health and Safety Code §17973 (commonly referred to as the “Balcony Inspection Laws” and as “Senate Bills 326 and 721,” respectively) or as may be or become applicable in other states, committed to serving our members and the public at large and providing valuable resources, education, and quality inspection tools necessary or helpful to the Exterior Elevated Element inspection community locally, regionally, and nationally.

The Association is open to properly licensed architects, engineers, and contractors, certified inspectors, and other qualified persons, who may be eligible for membership in the Association provided they meet and uphold the minimum requirements set forth in this application.

CATEGORIES OF MEMBER ELIGIBILITY

(1) PROFESSIONAL MEMBER ELIGIBILITY:

To become a Professional Member of the Association, you must meet or exceed the following minimum criteria:

  • be a properly licensed architect, structural engineer, civil engineer, general contractor with a minimum of 5 years’ industry experience, or ICC Certified Inspector, and maintain proper licensure and/or certification for the duration of your membership; and
  • agree and adhere to the Association Code of Ethics for the duration of your membership.
(2) ASSOCIATE MEMBER ELIGIBILITY:

While not eligible as Professional Members, you may be eligible for Associate Membership in the Association if you are among the following individuals or organizational representatives who provide support to Professional Member Inspectors and meet or exceed the following minimum criteria:

Individual Members must:

  • be individuals in positions related to the construction industry and the inspection of Exterior Elevated Elements; and
  • agree and adhere to the Association Code of Ethics for the duration of your membership.

Organizational Representatives must:

  • be representatives of an organization or municipality engaged in, inter alia, research, design, development, testing, manufacture, distribution, training, inspection, and/or repair related to the construction industry and the inspection of Exterior Elevated Elements; and
  • agree and adhere to the Association Code of Ethics for the duration of your membership.
(3) AFFILIATE MEMBER ELIGIBILITY:

While not eligible as Professional Members, you may be eligible for Affiliate Membership in the Association if you meet or exceed the following minimum criteria:

  • you are a manufacturer, vendor and/or supplier providing services and products for the repair of damaged Exterior Elevated Elements, such as waterproof deck coatings and sealants; and
  • agree and adhere to the Association Code of Ethics for the duration of your membership.

***All membership applications are subject to review by the Association, which may reject an application on any basis at the Association’s sole discretion and without explanation. Once accepted for membership, a member must continue to meet or exceed the eligibility criteria set forth herein or have his/her/its membership status subject to revocation.

E3 INSPECTION ASSOCIATION CODE OF ETHICS

Every member of the E3 Inspection Association (“Association”) shall comply with the following Code of Ethics. Any violation of the Association’s Code of Ethics constitutes grounds for disciplinary action, including revocation of member status and expulsion from the Association.

ARTICLE I – COMPETENCE
  1. Association members shall undertake to perform professional services only when qualified to do so by licensure, certification, education, training, and/or experience, as required by applicable laws and the specific technical areas involved. Association members may also engage as subconsultants individuals from other disciplines who members believe in good faith may provide relevant knowledge and/or expertise, as may be mutually agreed upon by and between Association members and their clients
  2. Association members shall have knowledge of applicable building laws, codes, ordinances, and regulations and shall not knowingly provide services in violation thereof. Association members may obtain the advice of other professionals, including architects, engineers, contractors, certified inspectors, attorneys, or other qualified persons to ascertain the intent and meaning of such laws, codes, ordinances, and regulations.
  3. Association members shall act with reasonable care and competence and shall apply the technical knowledge and skill which is ordinarily applied by qualified professionals of good standing practicing in California or their home state and performing services under similar circumstances, conditions, and time.
  4. Association members shall not provide legal advice unless they are licensed to do so.
ARTICLE II – DUTIES:
  1. Association members shall be fair, honest, impartial, and act in good faith in dealing with their clients and other professionals.
  2. Association members shall not discriminate in any business activities on the basis of race, color, religion, sex, creed, age, national origin, familial status, sexual orientation, physical or mental disability, and shall comply with applicable federal, state and local laws, rules, codes, ordinances, and/or regulations.
  3. Association members shall not communicate any information about an inspection to anyone except the relevant client, the affected resident(s), if appropriate, and/or the applicable governmental authority without the prior consent of the client and/or its legal representative, except in a case where there may be an immediate impact on public safety or as otherwise required by laws, rules, codes, ordinances, and/or regulations.
  4. Association members shall act in the best interest of their clients, unless doing so would be in violation of this Code of Ethics or other applicable laws, rules, codes, ordinances, and/or regulations.
  5. Association members shall use written contracts that specify the services to be performed, the scope and any limitations of services, and the fees to be charged for the services.
  6. Association members shall strive to improve the Exterior Elevated Elements Inspection profession by sharing their knowledge, expertise, and/or experience for the benefit of other Association members and the public at large. This duty does not preclude Association members from copyrighting and marketing their services and products in any manner permitted by law.
  7. Association members shall not infringe upon the copyrighted works of any other Association member.
  8. Association members shall not say, write, or cause to be said or written any statement that may be considered defamatory, derogatory, private, misleading or disparaging about another Association member or his/her/its officers, directors, employees, agents, Page 7 of 10 representatives, members, managers, attorneys, affiliates, divisions, subsidiaries, and related companies.
  9. Association members shall accurately represent to a prospective or existing client his/her/its qualifications and scope of responsibility in connection with projects or services for which he/she/it is claiming credit.
ARTICLE III – CONFLICT OF INTEREST:
  1. Association members shall not accept compensation for services from more than one party on a project unless the circumstances are fully disclosed to and agreed upon in writing by all applicable parties.
  2. Association members shall disclose to a client the nature of any actual conflict of interest which is substantial enough to influence his or her judgment in connection with the performance of professional services for that client as it may relate to the inspection of the client’s Exterior Elevated Elements and provide such client with the opportunity to terminate the contract for inspection services with the Association member resulting therefrom.
  3. Association membersshall not solicit or accept payments, rebates, refunds, commissions, or gifts, whether in the form of money or otherwise, in return for referring their services or specifying their products to other Association member clients.
ARTICLE IV – ASSOCIATION LOGO & IDENTIFICATION:
  1. Association members shall proudly incorporate the E3 Inspection Association logo into their business cards, professional websites, and other business-related materials.
  2. Association members shall proudly identify themselves on their business cards, professional websites, and other business-related materials as Association members.
  3. Association members shall not use the Association’s logo or name in any manner which disparages, demeans, or discredits the Association’s reputation or activities and shall not permit, facilitate or enable non-Association members to use the Association’s logo or name in any respect.
